HEARINGS:
1. Petition of James Clark, JC Transportation Co., Inc., DBA Brockton Cab to
transfer 6 Taxi licenses to Brian Parker, Brian’s Taxi, Inc., DBA Brockton Cab
located at 20 Putnam St.

 

REPORTS:
2. Of the Finance Committee for its meeting of January 18, 2011.

 

COMMUNICATIONS:
3. From the Fire Chief requesting the acceptance and expenditure of a grant in the
amount of $11,515.00 from the Commonwealth of Massachusetts Department of
Public Safety. This is a non-matching grant with no cost to the City. These funds
are intended for the Fire Safety Education Program.
4. From the Mayor in accordance with M.G.L., Ch. 44, recommending an
appropriation of $11,515.00 from Commonwealth of Massachusetts Executive
Office of Public Safety, Programs Division to Fire Department-Student
Awareness of Fire Education (SAFE) Grant Fund in order to provide funds to
conduct Fire Education Program.
5. From the CFO in accordance with Section 5 of Ch. 324 of the Acts of 1990,
certifying the proposed appropriation of $11,515.00 from the Commonwealth of
Massachusetts Executive Office of Public Safety, Programs Division to Fire
Department-Student Awareness of Fire Education (SAFE) Grant Fund in order to
provide funds to conduct Fire Education Program.
6. From the DPW Commissioner requesting the acceptance of the MassReleaf
Memorial Tree Grant from the Commonwealth of Massachusetts Department of
Conservation and Recreation in the amount of $6,000.00.The City plans to
purchase approximately 60 deciduous trees and Austrian Pine trees for the
purpose of restoring trees to a section of Rt. 24 in Brockton. The Massachusetts
Department of Transportation (MassDOT) is committed to working with the City
by planting these trees.
7. From the Mayor in accordance with M.G.L., Ch. 44, recommending the
acceptance by the Department of Public Works of the award from the
Commonwealth of Massachusetts Department of Conservation and
Recreation,and further that the City Council appropriate $6,000 from Available
Funds-Commonwealth of Massachusetts-Department of Conservation and
Recreation MassReleaf Memorial Tree Grant to DPW-MassReleaf Grant Fund.
This grant ends June 30, 2011.
8. From the CFO in accordance with Section 5 of Ch. 324 of the Acts of 1990,
certifying the proposed grant of $6,000 from the Commonwealth of
Massachusetts-Department of Conservation and Recreation to DPW-MassReleaf
Memorial Tree Grant
9. From the DPW Commissioner requesting to expend additional funds up to an
amount of $1,500,000.00 for the purpose of FY2011 snow removal in accordance
with Ch. 44, Section 31D of M.G.L.
10. From the Mayor in accordance with M.G.L., Ch. 44, Section 31D and the request
of the DPW Commissioner, requesting the City Council authorize the expenditure
of up to $1,500,000 in excess of funds already appropriated for snow removal in
FY2011.
11. From the CFO in accordance with Section 5 of Ch. 324 of the Acts of 1990,
certifying that the expenditure of $1,500,000 in excess of the already appropriated
FY2011 snow removal budget will have a detrimental effect on the continuous
provision of the existing level of municipal services. This action will enable
deficit spending in FY11, and if utilized, it either must be raised by reserves this
year or from the FY2011 revenues during a budget year which already will lack
sufficient revenues.
UNFINISHED BUSINESS:
12. Ordinance: An Ordinance amending Chapter XXIII of the revised ordinances of
the City of Brockton. Be it ordained by the City Council of the City of Brockton
as follows: Chapter 23. Water, Sewers and Sewage Disposal, Sec. 23-30(f)(6).

13. Ordered: That the City Council approve an increase from $6000 to $9000 in the
amount of supplemental pension allowances to surviving spouses of disabled
employees.(FAVORABLE)
14. Appropriation of: $229,840 (which is 80%)
From: Federal Emergency Management Agency (FEMA) and the Department of
Homeland Security (DHS)
To: Fire Department-FEMA and DHS Grant. (The Fire Department intends to
use these grant funds to purchase new Turnout Gear for all members of the
Brockton Fire Department. The city share of 20% was included in the FY11
budget in anticipation of this grant) .(FAVORABLE)
15. Appropriation of: $145,891.80
From: Commonwealth of Massachusetts Executive Office of Public Safety-
Edward J. Byrne Memorial Justice Assistance Grant (JAG)
To: City of Brockton Police Department-Justice Assistance Grant (JAG) Program
Local Solicitation Funds. .(FAVORABLE)
16. Resolved: That the Treasurer-Collector and the Chief Financial Officer be invited
to appear before a committee of this Council to discuss the transfer of unpaid
water bills onto real estate tax bills. .(FAVORABLE)

excess of funds already appropriated for snow removal in FY2011.
20. Ordered:That the DPW Commissioner is authorized to issue a single family sewer
connection for the property located on Combined Lots 38 and 39, Plot 4 Douglas
Ave.- Connection to Douglas Avenue. The property is currently owned by
Michael Juliano.
21. Ordered:That the DPW Commissioner is authorized to issue a single family sewer
connection for the property located on Combined Lots 59 and 60, Plot 5 Douglas
Ave.- Connection to Oscar Avenue. The property is currently owned by Michael
Juliano.
